By accessing or using Trip Assistant ("Service"), operated by PIAZR PTY LTD, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Trip Assistant is an AI-powered travel planning platform that helps users create, organize, and share travel itineraries. The Service includes:
- AI-generated trip itineraries and recommendations
- Trip collaboration and sharing features
- Travel research and booking integration
- Marketplace for trip templates (available on Pro tier and above)
3. Account Registration
To access certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password and account
- Notify us immediately of any unauthorized use
- Be responsible for all activities under your account
4. Subscription Plans
4.1 Subscription Tiers
Trip Assistant offers multiple subscription tiers:
- Free: Limited trip creation (2 trips/month), view shared trips
- Explorer ($9.99/month): 10 trips/month, advanced features
- Traveler ($19.99/month): 30 trips/month, priority support
- Pro ($39.99/month): 100 trips/month, marketplace access, API access
4.2 Billing
- All paid subscriptions include a 14-day free trial
- Billing occurs monthly or annually based on your selected plan
- Subscriptions auto-renew unless canceled
- Payment processing is handled by Paddle.com, our Merchant of Record
- Prices are in USD and may include applicable taxes
4.3 Cancellation
- You may cancel your subscription at any time
- Cancellations take effect at the end of your current billing period
- No refunds are provided for partial billing periods
- You retain access to paid features until the end of your billing period
4.4 Refunds
- We offer a 30-day money-back guarantee for first-time subscribers
- Refund requests must be submitted within 30 days of initial purchase
- Refunds are processed through Paddle.com
- Abuse of refund policy may result in account termination
5. Usage Limits
Your subscription tier determines your usage limits. Exceeding limits may result in:
- Temporary restriction of features until the next billing period
- Prompts to upgrade to a higher tier
- Account suspension if abuse is detected
6. User Content
6.1 Your Content
You retain ownership of all content you create using the Service. By using the Service, you grant us:

- Permission to use AI models to generate and enhance your trip content
- The right to share your content with collaborators you designate
6.2 Marketplace Content
If you sell trip templates in our marketplace, you agree that:
- You have the right to sell the content
- Trip Assistant receives a 15% commission on sales
- Buyers receive a perpetual license to use purchased templates
- You may not include illegal, offensive, or copyrighted content
7. AI-Generated Content
Trip Assistant uses artificial intelligence to generate travel recommendations and itineraries. You acknowledge that:
- AI-generated content may contain inaccuracies
- You should verify all travel information before making bookings
- We are not liable for errors in AI-generated content
- Trip conditions, prices, and availability change frequently
8. Prohibited Uses
You may not use the Service to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Upload malicious code or viruses
- Scrape or harvest data from the Service
- Resell or redistribute the Service without authorization
- Create fake accounts or impersonate others
- Abuse the AI system to generate inappropriate content
9. Intellectual Property
The Service, including its design, code, and AI models, is owned by Trip Assistant and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.
10. Privacy
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.
11. Third-Party Services
The Service integrates with third-party services for payments (Paddle), maps, and travel bookings. Your use of these services is subject to their respective terms and conditions.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
We do not guarantee that the Service will be uninterrupted, secure, or error-free.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIP ASSISTANT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless Trip Assistant from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of third-party rights
- Content you upload or share
15. Termination
We may suspend or terminate your account at any time for:
- Violation of these Terms
- Fraudulent or illegal activity
- Non-payment of fees
- At our discretion with 30 days notice
Upon termination, your right to use the Service ceases immediately.

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.
17. Governing Law
These Terms are governed by the laws of Australia. PIAZR PTY LTD is an Australian company and disputes will be resolved in accordance with Australian law.
18. Dispute Resolution
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that you may bring claims in small claims court.
